Official Rules

NO PURCHASE REQUIRED TO ENTER OR WIN. ONLY RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY ARE ELGIBLE TO ENTER. VOID WHERE PROHIBITED.

1. How to Enter: The "Snuggle Spin to Win Game" is an online Instant Win Game (the "Game"). To enter: During the Promotion Period, go to [Only registered and activated users can see links. Either login above or Register Now] and follow the links and instructions for entry. Fill out the online entry form completely and submit the form. Once you submit the form, follow the directions to advance to the Game page and to play the Game. You will be presented with three (3) images. Click the "Spin" button and the three (3) images will spin. Click on the "Stop" button below each image to stop the images from spinning. If the three (3) images match, you will be a potential winner of one (1) of the Instant Win prizes. If you are an Instant Winner, you will receive an email explaining how to retrieve your prize. You may play the Game one (1) time each day during the Promotion Period. A day is defined from 12:00:00 am ET to 11:59:59 pm ET. Bonus Game Plays: You can receive bonus Game plays by referring your friends to the Game. When prompted, submit the name and email address of a friend, who will be sent an email about the Game from you. You may only refer persons with whom you have an existing personal relationship and whom an email from you would not be considered spam. You may refer up to four (4) friends each day. However, you will receive only one (1) bonus Game play per day regardless of how many referrals you make. A random, computer-generated winning time will be generated for each of the Game prizes to be awarded. If you are the first person to play the Game at or after one (1) of the winning times, you will be an Instant Winner. There are One Thousand One Hundred (1,100) Instant Win Prizes. The odds of winning any prize are based on the number of Game plays during the Promotion Period divided by the total number of prizes. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

2. Game Prizes: ONE HUNDRED (100) GRAND PRIZES: One (1) year magazine subscription to winner’s choice of Child, Parents, Fitness, or Family Circle magazine. Approximate Retail Value ("ARV"): $25. ONE THOUSAND (1,000) FIRST PRIZES: Snuggle Bear. ARV: $10. Each winner is solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use. No substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute any prize or combination of prizes with another prize of greater or equal value. The total value of all prizes to be awarded in the Game is $12,500.

3. Winners: If a potential winner cannot be contacted within ten (10) days after the first attempt to contact him/her an alternate entrant will be selected in his/her place at random from among all eligible entries received. All eligible winners of Game prizes will receive their prize by mail within 8-10 weeks after notification of winning. Winners are eligible to win only one prize during the Promotion Period.

4. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

5. Eligibility: The Game is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age at the time of entry. Void where prohibited. When entrant enters online, entrant must have a valid email address at the time of entry. Employees of Unilever United States, Inc., Draft, Inc., ePrize, LLC and their respective related companies, agents and suppliers, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Subject to all federal, state and local laws and regulations.

6. Agreement to Official Rules: By participating in the Game, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding.

7. Timing: The Game begins at 12:01 a.m. Eastern Time ("ET"), August 10, 2004 and ends at 11:50 p.m. ET, October 29, 2004 (the "Promotion Period").

8. Publicity: Except where prohibited, participation in the Game constitutes a winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel or modify the Game if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Game, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Game or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Game is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Release: By entering the Game, entrant agrees to release and hold harmless, Sponsor, Draft, Inc., ePrize, LLC, each of their related companies, and each of their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising directly or indirectly, in whole or in part, out of participation in the Game or receipt or use of any prize.

11. Limitations of Liability: The Released Parties are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Game, including without limitation in accurate transcription of entry information; (iv) electronic or human error which may occur in the administration of the Game or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game or accessing or downloading information or materials connected with the Game.

12. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Game, or any prizes awarded, other than the administration of the Game or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Michigan (Eastern Division) or the appropriate Michigan State Court located in Oakland County, Michigan, U.S.A.; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Game but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A.

13. Entrant's Personal Information: Information collected from entrants is subject to both the ePrize Privacy Policy ([Only registered and activated users can see links. 14. Winners List: A list of major prize winners and a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to "Snuggle Spin to Win Game Winner/Rules Request", c/o ePrize, LLC, P.O. Box 9052, Farmington Hills, MI 48333-9052. Requests for winner’s list must be received within thirty (30) days after the promotion end date. Vermont residents may omit return postage.
