Motorola phone question--used phones?

It's been a long time since I posted here (life happens) but I have a question I hope someone can answer. I accidentally dropped my work cell phone and the "flip" part stays open unless I keep a rubber band around it. I want to replace the phone and have looked at ebay to find a good used phone (the phone is at least a couple years old).

Before I buy, is there anything I need to watch for? Assuming the phone I get hasn't been stolen, do I need to watch out for high activation fees? I'm not changing plans or anything, just changing the physical phone...

Which style of motorola phone is it that you need to replace???

You should not have any activation fees if you are just doing an equipment change.

It's the old-style motorola i1000 plus flip phone.
