*sigh* ebay problem

I purchased an instrument and received it today and it is not at all like the description. The seller said small dings but the are huge dents and the instrument is not playable as the description described. I sent an email asking the seller to work with me to resolve the problem and that I would wait to leave feedback until the issue was resolved.

What do you think is the best way for this to be resolved? Some money back? return the instrument for all money back including the price to send the instrument back? How long should I wait for a response? When I do get a response if I am not happy how many times should i try to negotiate a solution that makes both the seller and I happy before I leave feedback?

I want to be a responsible buyer and I want to give this person a chance but I don't want to be walked all over. I even had my bf help me write the email because I wanted to make it sound as nice as possible but I also didn't want to sound like I was going to let them get away with anything. The seller has a 99.5% feedback rating with almost 200 feedback responses.

PLEASE HELP ME!! I have never had a problem at ebay before. thanks.

Depending on the amount spent, you do have some leverage with ebay. Of course, they want you to try and resolve it with the seller first, which is what you're doing. If that doesn't work, you can file a claim under ebay's Fraud Protection Center. As a buyer, I've never had to do this. As a seller, I've done it twice in three years. Contrary to my statement on another thread here, this is one area where ebay will get involved, but again, it depends on the amount of money trading hands. If you can't get things resolved amicably with the seller, that's your safest route. But REMEMBER: You only have 30 days from the date the auction closes in which to contact ebay about this, so stay on top of it! Good luck to you!

Awww...you know, every once in awhile I run into this. I think you are right to give the seller a chance to resolve, but I would say that he/she should respond very quickly. I think what should be done is really up to you. You'll have to factor how much it would cost to bring it to the playable condition you expected. As far as the dents (I am assuming it's a brass instrument??), I have heard recently about a magnetic dent removal kit that can get those out better than the old way of repairing them (less $$$ too). A lot of school band teachers have those kits now. Good luck with this, and let us know how the seller resolves it for you!

he emailed me back and gave me 2 options, either return the instrument for a full refund or offer him a different price and if he accepts he will refund the difference. I paid $39.99 for the Holton trombone plus shipping which was $11. I am going to discuss it with my bf but what do you guys think?

He is being reasonable so I will continue to be reasonable.

At least he has emailed you back. I had a bad experience with someone who woudln't even return my emails. I went through ebay eventually still nothing was done so I would say work with the seller since he has emailed you back.

If it was me I think I would ask for shipping back plus $10......that is if you feel that the item was totally misrepresented and if the item is still functional and can be repaired.....OR get an estimate on what it would cost to fix the instrument and send him a copy of that and let that be the amount he refund you.

I called and got a rough estimate of the repairs and asked that he refund the lowest estimated amount that the repair will cost. I am waiting for the reply.
