Register Now] *1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. CONTEST VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 2. The contest begins at 12:01:00 PST on the later of May 22, 2001 and the launch of potterybarnkids.com (the "Start Date") and ends at 11:59:59 PST on August 1, 2001. 3. The contest is open to legal residents of the United States of America, except for residents of Puerto Rico, who are 18 years or older as of the Start Date. 4. Prize: a Pottery Barn Kids Dream Room made up of $5,000 of Pottery Barn Kids merchandise (net of taxes and any shipping or other applicable retail charges). Merchandise can only be purchased in one transaction from Pottery Barn Kids catalog or web site. Merchandise must be ordered by 11:59:59 PST on December 31, 2001. Pottery Barn Kids, Inc. reserves the right to substitute a prize of equal or greater value in its sole discretion. 5. The odds of winning depend upon the number of eligible entries received. 6. The prize cannot be redeemed for cash and may not be substituted or transferred by the winner. 7. There is only one way to enter this contest: on the Pottery Barn Kids' web site located at potterybarnkids.com. Once on the website go to the Sign In page and click on Create an Account. Once in the Create an Account page complete the form including Account Information, Billing Information and Shipping Information (which includes your name, address, e-mail address and phone number) and send your entry by hitting the submit link on the Create an Account page. All web site entries must be received by 11:59:59 PST on August 1, 2001 Only one entry per household (to be determined by the shipping and/or billing address) is allowed. 8. Pottery Barn Kids, Inc. is not responsible for telecommunications, network, electronic, technical or computer failures of any kind to entry forms. Entries that are generated by a script, macro, or other automated means and/or otherwise not in compliance with these rules will be disqualified. Pottery Barn Kids, Inc. shall have the absolute right to determine if an entry form is in compliance with these rules. 9. By entering the contest, each participant warrants that he or she has read and agrees to abide by all contest rules and that he or she is not prohibited from participating in the contest. Each participant agrees to release, discharge, indemnify and hold harmless Pottery Barn Kids, Inc. and its parent, subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the contest, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. 10. Employees and agents, including their family and members of their household, of Pottery Barn Kids, Inc. and its parent, subsidiaries and affiliates are not eligible to participate. 11. The contest winner will be determined by a random drawing from among all eligible entries on or around August 8, 2001. The drawing will be conducted at Pottery Barn Kids, Inc.'s corporate offices located at 151 Union Street, in San Francisco, California, with the winning number randomly generated by a computer. All results of the drawing are final and binding. 12. After the first entry form is selected, a second entry form will be selected and placed in a sealed envelope. The sealed envelope will be given to Pottery Barn Kids, Inc.'s in-house counsel, to be held in trust. In the event that the first entry form selected is discovered to be invalid for any reason whatsoever, or if the person who submitted the first entry form does not contact Pottery Barn Kids, Inc. within the time frame specified in paragraph 15 below, the person who submitted the second entry form selected will become a winner, subject to the same rules and conditions set forth herein. 13. If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. 14. The winner will be required to sign and return to Pottery Barn Kids, Inc. an Affidavit of Eligibility and a Prize and/or Publicity Release. 15. Attempts to notify the winner will be made by first class mail, e-mail and/or telephone. Pottery Barn Kids, Inc. is not responsible for lost, stolen, late or misdirected mail. If unable to make contact with the winner within thirty (30) days after Pottery Barn Kids, Inc. first attempts to notify the winner, or if the winner fails to claim the prize, Pottery Barn Kids, Inc. will select the winner chosen in accordance with paragraph 12 above. Likewise, if the original winner is ineligible or fails to timely return the signed Affidavit and Release(s), or in the event of non-compliance with any other requirements of this contest, the winner shall forfeit the prize in its entirety, and Pottery Barn Kids, Inc. will award the prize to the alternate winner. 16. You can obtain a list of the official winner (after the conclusion of this contest) by sending a stamped, self-addressed envelope to: Winner, "Pottery Barn Kids Dream Room Contest", 3250 Van Ness Avenue, San Francisco, California 94109. Please be certain to specify that you are requesting the "Official Winner List for the Pottery Barn Kids Dream Room Contest." 17. The prizewinner is responsible for any and all income, sales or excise taxes that may apply, and Pottery Barn Kids, Inc. shall not be liable for any such expense. 18. By entering this contest, participants consent to the use of their name, likeness, image and biographical data for advertising and promotional purpose without additional compensation, except where prohibited by law. BECAUSE POTTERY BARN KIDS, INC. COLLECTS PERSONAL INFORMATION FROM PARTICIPANTS ENTERING THIS CONTEST, POTTERY BARN KIDS, INC. ENCOURAGES ALL PARTICIPANTS TO REVIEW ITS PRIVACY POLICY. 19. Pottery Barn Kids, Inc. reserves the right to terminate this contest or modify any rules as necessary for any reason or as required by applicable law. Pottery Barn Kids, Inc. reserves the right, at its sole discretion, to disqualify any person it believes has intentionally violated these rules or tampered with any element of this contest. 20. All entry forms become the property of Pottery Barn Kids, Inc. and will not be returned. 21. The sponsor of this contest is Pottery Barn Kids, Inc. having an address of 3250 Van Ness Avenue, San Francisco, California 94109. 22. This Agreement is governed by the laws of the State of California, without giving effect to conflicts of law rules. 23.
