If I my order was not shipped within 48 hours as the sales person indicated over the phone, and was not shipped by Express mail, which we paid for, is this a violation of the telephone order merchandise rule?

Although the sales persons claimed it was mailed on time, via Express mail, he could never give us a tracking number and then a week later came up with a Priority Mail tracking number which never tracked. We repeatedly asked whether there was an error and could we cancel the order.

On the last day, we told him that the same product was available at another company, for $104 less and that we would like to cancel and order from them. He basically said No Need to, your is on the way. He kept claiming it was on its way and stringing us along, until now, we had no time to order it from someone else and still have hope of receiving it before my husband deploys for the Balkans.

He finally mailed a second order, 10 days after the original order, via Express Mail. He said he would make it up to us (order something at cost were his words), but refused to match the price of the other vendors. If we wanted this order before my husband left TDY, then we had to use him.

Is there anything I can do. File with the BBB, ugetheard.com, planetfeedback, and ...???? Does he really have to sell us something at cost since he said he would (over the phone).

We are fairly sure he has lied to us repeatedly.

If this were me, I'd file with all that you mentioned, and be sure they know you are doing so.

If you used a Credit Card just call up your company and say you were incorrectly charged (all that s/h stuff you mentioned)

It is always way easier to go thru the CC company and let them deal with the stupid vendor
