Re: Beware "Time Factor"!

Well, I would be careful of stopping a payment on the check and making them wait you out on payments, you did agree to legal conditions when you took that advance/loan out, so they can sue you for their money, they can continue to try and debit it from your bank, and if you blocked them electronically, all they have to do is go show your bank the paperwork and proof that you authorized the debit as part of your original agreement, then your bank will have to let them try to take it out of your account, and you will end up with repeated bounce fees.

On top of these tactics, they will continue to add more fees and interest, the longer you go without paying, and like I said, you made a legal agreement with them, and it is considered your responsibility to read all the fine print, they don't have to tell you all of it, they just have to make the information available to you as full disclosure, whether you check into or read all the details is not their problem.

They can also throw all of this on your credit rating, including lates and not paid as agreed statements, making serious derogatory marks on your credit. So even if you manage to keep them out of your bank account, they will get you in other ways.

On top of any other things they might try to collect and cause you hassles for non-payment, they can report you to Chex Systems for writing bad checks or authorizing bad account withdrawals, once in their system, it stays on there for 5 years, once you are reported on there, your bank can close all of your accounts if they so choose, even though you didn't do anything wrong there, but some of them have a policy that if you are actively listed with Chex, no accounts at all and new banks won't let you open one either, as long as you are listed. If you get reported to Chex two or more times, some banks will NEVER let you open another account. They are basically a type of credit report for banking practices, there are a few banks that don't use them, but most rely on their reports before authorizing an account to be opened. They can also report you to SCAN which keeps track of returned checks and fraud to help banks screen applicants or account holders, and TeleCheck.

You can see some details about each at this link:

We were once turned into Chex Systems by a bank that made a mistake. We had bounced a check, and we did take care of the fees at the bank and the store immediately, even though the bank closed our account for just ONE overdraft. However, the store never reported to the bank that we had gone in and taken care of it. So even though we made good on the check at the bank, they still reported us for bad check writing, just because they didn't think we'd made good at the store. We moved right after this, and since we had taken care of it all, I didn't worry to much about my receipts, and lost track of them in all the packing/unpacking mess. Anyway, things were fine until we tried to get a new checking account at another bank, they refused, we tried another, same thing. So I started hunting online and learned about Chex Systems. I fought with them over it for so long, that before I ever got it all straightened out, even though I went back to the store, and the bank, and got proof that we had never cheated either of them, the 5 years was finally up, before they ever agreed to take our names off their reporting list!

Finally, after all the back and forth, sending documentation and etc. The bank were we had a savings account said we were eligible for a checking account again, then of course, a few weeks later, we get a notice from Chex that they had realized the error made by them and our old bank and were deleting our names from their system. Oh goody, thanks a lot, it really helped a lot then!

Anyway, to get you listed there, all they have to do is report that you did not make good on that debit from your account to pay this, which is considered basically an electronic check, or in some cases these payday loan places even make you give them a real check to hold, and then Chex asks your bank, finds out you stopped the payment on something you agreed to pay, and you are on their list, like I said with many potential problems, including your current bank possibly closing your account.

So if you want to avoid a ton more fees being added, collection calls, a possible lawsuit, and damage to your credit and banking reports, you really need to take care of paying them IMMEDIATELY! I know you are being lackadaisical about this because you think you tromped them by stopping that payment, but you really didn't, and you are just going to get yourselves in even more trouble in the long run, if you don't take care of it soon.

Oh and even if you pay them in payments, they are not obligated to accept anything other than the amount in full immediately, and even if they take your payments, they can still sue you, file you with Chex, report it on your credit and etc. If you look up debt collection laws, like the Fair Debt Collecting Practices Act (FDCPA) you will see that the things people tell you about it being paid in full if they refuse a payment, or any amount of payment stopping a lawsuit or other action is a total myth and not true at all.

Re: Beware "Time Factor"!

Time Factor's address is 2060 E. Francis St, Ontario, CA 91761 Southern Ca Better Business Bureau.

I did trial order july 5, saw the $16.95 upcharge late. I immediatly called to cancel order, called 8-10 time in next 10 days, always got message machine promising to call back. I gave then my info and told them I wanted to cancel on each message. About the 15th I received product shipment. 2 days later had return call. Too late to cancel, stop shipment.

I've asked them for refund of all but $3.95 trial. I informed BBB of this today, the 27th.

Maybe enough complaints will stop the deception.

Hi,

Sorry so many of you got taken and that's what it feels like is taken. Maybe if you all filed with the BBB, and your credit cards, if that's how you paid, they will get the message and change this ridiculous policy. And have the common courtesy to call people back, promptly.
Link for the online BBB is:

Click on File A Complaint at the left hand side of the page. Can't hurt, for sure.
