Unfortunately, as more of the dotcoms go under, the only thing that their creditors can get ahold of are their customer lists, (no matter their privacy policy before the banktruptcy). The court looks at many different things in a bankruptcy, one of which is if there is anything that can be sold to re-coup creditors' money. Many times, the biz only has its customer information which they have spent many hours and a ton of money developing. I wouldn't hold my breath to be notified and able to opt-out each time something like this happens. From what I understand, each court can rule differently each time (depending on the circumstances).
