Defunct furniture e-tailer living.com has reached a settlement with the Texas Attorney General that allows it to sell its customer and registered user lists to a third party, mail-order product provider Maxwell Sroge Company. Personal financial information will not be included in the sale. living.com customers who receive a message from living.com may opt-out of the sale to Maxwell Sroge by replying to the received email within seven days or receipt.

Unfortunately, as more of the dotcoms go under, the only thing that their creditors can get ahold of are their customer lists, (no matter their privacy policy before the banktruptcy). The court looks at many different things in a bankruptcy, one of which is if there is anything that can be sold to re-coup creditors' money. Many times, the biz only has its customer information which they have spent many hours and a ton of money developing. I wouldn't hold my breath to be notified and able to opt-out each time something like this happens. From what I understand, each court can rule differently each time (depending on the circumstances).
