Official Rules
NO PURCHASE NECESSARY. Sweepstakes ("Sweepstakes") open to all legal residents of the continental United States, age 21 years or older, except employees (and their immediate families and household members) of Harpo Productions, Inc. ("Harpo"), KGO ("KGO"), Disney Enterprises, Inc., King World Enterprises ("King World") and their respective parents, subsidiaries, franchisees, advertising promotion agencies and affiliated entities (the "Sponsors"). Persons who have won a prize from any of the Sponsors since January 1, 2003 are ineligible to participate. Void wherever taxed, prohibited or restricted by law. Sweepstakes is subject to all federal, state and local laws and regulations. By entering the Sweepstakes, entrants agree to accept and be bound by all terms of these Official Rules.
HOW TO ENTER: From 4:00 pm (PT) on Monday, November 3, 2003 until 3:59 pm (PT) on Tuesday, November 11, 2003 (the "Promotional Period"), KGO will conduct a Sweepstakes encouraging participants to watch The Oprah Winfrey Show (the "Show") , look for the clue of the day (the "Daily Clue") and then log on to KGO's website, located at
www.abc7news.com (the "Website"). To enter, participants may log on the Website between 4:00 pm (PT) and 3:59 pm (PT) each day of the Promotional Period and complete and submit the online entry form, including their name, address, daytime phone number, nighttime phone number (if different), email address and the Daily Clue. On Nov. 8-9, the Daily Clue will be the one provided on Friday, November 7th's episode of the Show. To be eligible, all entries must contain the corresponding Daily Clue and be received by 3:59 pm (PT) each day of the Promotional Period. All entries must be submitted in the name of an individual person and prizes will only be awarded to the person whose name is on the winning entry. All entries become the property of KGO and will not be returned. Limit one (1) entry per person, e-mail address or household per twenty-four (24) hour period. All other entries will be deemed void. No mechanical reproductions, mail-in entries or facsimiles accepted. Sponsors are not responsible for misdirected, incomplete, lost, late or illegible entries, technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit prize fulfillment or an individual's ability to enter the Sweepstakes. Sponsors reserve the right, in their sole discretion, to cancel, modify or prematurely conclude the Sweepstakes should any computer virus, malfunction or other cause beyond their control corrupt the administration, security or proper operation of the Sweepstakes. False or deceptive entries or acts will render the individual ineligible and Sponsors reserve the right to disqualify any individual who attempts to undermine the legitimate operation of the Sweepstakes by tampering with any Website mechanism, acts in a disruptive manner or violates these Official Rules. Any attempt by an individual to deliberately damage or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws. Should such an attempt be made, Sponsors reserve the right to seek remedies and damages (including attorneys' fees) from any such individual to the fullest extent of the law, including criminal prosecution.
HOW TO WIN: One (1) winner (the "Winner") will be randomly chosen by a representative of KGO on or around November 12, 2003, from all eligible entries received by the dates and times specified above. The decisions of the judges will be final and binding on all participants. The odds of winning will depend on the total number of eligible entries received during the Promotional Period. The Winner will be notified either in person, by telephone or e-mail by Sponsors within two (2) days of the drawing. The Winner must also meet all eligibility requirements and reply and execute all necessary releases within three days of notification. In the event that the Sweepstakes is canceled or ended prematurely due to the reasons set forth in paragraph 2 above, a Winner shall be randomly chosen by a representative of KGO from all eligible entries received as of the time of the impairment.
PRIZES: One (1) Winner will receive a two (2) day/one (1) night trip for two (2) to Chicago, IL, at an approximate market value ("AMV") of One Thousand Five Hundred Dollars ($1,500.00) (the "Trip"). The Trip includes: (i) hotel accommodations (one room), including applicable room taxes, for one (1) night at the Omni Hotel in Chicago, (ii) round-trip, coach class airfare for two from the destination airport nearest the Winner's residence, (iii) two tickets to the taping of "Favorite Things" episode of The Oprah Winfrey Show, (iv) ground transportation to and from the airport in Chicago and Harpo Studios, and (v) meal vouchers. TOTAL AMV OF PRIZES (1 PRIZE): One Thousand Five Hundred Dollars ($1,500.00). No substitutions, transfers of prizes or cash redemptions permitted by Winner. Winner must travel on dates specified by Sponsors or the prize shall be deemed forfeited and an alternate Winner selected (where possible). Sponsors reserve the right to substitute any prizes of like or greater value in the event the described prize, or any portion thereof, is unavailable for any reason whatsoever. Winner is responsible for all expenses not expressly provided for above including meals, beverages, souvenirs, entertainment, incidentals, tips, parking, telephone calls or other personal expenses incurred during or in connection with the Trip. Winner is responsible for the reporting and payment of all taxes (if any).
GENERAL RULES AND REGULATIONS: By entering this Sweepstakes, participants grant Sponsors the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the services of the Sponsors and all matters related to the Sweepstakes in any medium, throughout the world in perpetuity. The Winner and the Winner's travel companion (who must be a legal US resident, age 21 or older, and must travel with the Winner) may each be required to produce proof of identity, address and birth date, as well as sign an affidavit of eligibility, tax acknowledgment form, liability release and, except where prohibited by law, use of name and likeness releases in order to claim the prize. Such documents must be completed in full and returned within three (3) days of issuance either via facsimile or US registered mail. Failure to do so or if: (i) any prize or prize notification is returned as undeliverable, (ii) the Winner declines his or her prize, or (iii) a potential Winner is determined to be ineligible for reason, will result in disqualification of such Winner and an alternate winner may be selected by random drawing at the Sponsors' discretion. Sponsors will use reasonable efforts to pick an alternate winner but in the event an alternate winner cannot be determined in the time frame necessitated by the nature of the prize, the prize will go unawarded. Sponsors and their respective parents, subsidiaries, franchisees, advertising promotion agencies and affiliated entities expressly disclaim any responsibility and entrants agree to hold Sponsors harmless for liability for injury or loss to any person or property (including death) relating to participation in this Sweepstakes, the delivery and/or subsequent use or misuse of any of the prizes awarded and claims based on publicity rights, defamation or invasion of privacy. Sponsors further assume no liability either for the cancellation, modification or premature conclusion of the Sweepstakes for any reason or through the acts or defaults of any company or person providing any prize. All such losses or expenses must be borne by the affected participants and/or Winner.
